Proposed Changes to the Phase-out of STRs from RM Zones

In August of 2019, a Bill was passed to phase non-owner occupied STRs out of RM zones by January 1, 2022. A new bill has been proposed that would slightly loosen the restrictiveness of that law.

Council Member Larry Hagar sponsored BL2021-913, which will be heard on first reading at tonight’s Metro Council Meeting.

The original Bill (2019-1633) that sunsets NOO STR permits in RM zones was worded in a way that ends eligibility for anyone who has not received their permit by January 1, 2022. The new proposed bill would allow permits to be processed for anyone who has submitted their application prior to that effective date. The new bill would mean that as long as you’ve submitted your NOO permit application for a property in RM zoning by December 31, 2021, you are eligible to receive a permit.

Amended bill passed into law on November 2, 2021. “Anyone with an active short term rental property – not owner occupied permit application on file with the Department of Codes Administration as of December 31, 2021, shall be eligible for that permit to be issued if all other conditions are met and if the final use and occupancy letter for the building is issued on or before December 31, 2021.”
