Rezone of Germantown Historic District to Exclude STRs

Back in February, Bill BL2019-111 passed into law, creating new -NS zoning districts which prohibit STR use. Leading up to the final vote, we voiced significant concern about this bill as it would open the door for properties, streets, and entire neighborhoods to be rezoned to eliminate short term rentals.

Metro Council repeatedly stated that this would not be used to issue blanket downzones and would only be utilized for new zoning requests initiated by a property owner or developer. However, Councilmembers Freddie O’Connell and Kathleen Murphy have presented a new bill that would do exactly as was feared.

Bill BL2020-479 aims to rezone the entire Historic Preservation Zoning Overlay in Germantown to the new non-STR zoning.

The bill passed first reading at Metro Council on October 6, 2020, and the public hearing was deferred until December 1, 2020.
